Ch. 468

1994 LAWS OF MARYLAND

(c) While receiving an allowance under the Employees' Retirement System of the
State of Maryland or the [Pension System for Employees] EMPLOYEES' PENSION
SYSTEM of the State of Maryland, a former employee or a former employee's surviving
spouse or dependent child:

(1)      may enroll and participate in the health insurance benefit options
established under the Program; and

(2)      except as provided in subsection (d) of this section, is subject to the same
terms and conditions as those provided under § 8-108 of this subtitle, with the employee's
service with the Maryland Environmental Service being included; as part of the
employee's State service.

(b)     A contractual employee who transfers to a budgeted position under this
subtitle shall become a member of the [State pension system] EMPLOYEES' PENSION
SYSTEM OF THE STATE OF MARYLAND.

29-103.                                     

(c)      (1) This subsection applies to a member of the State Police Retirement

System.

(2)    The Superintendent of the Maryland. State Police may complete an
application and submit it to the Board of Trustees for a member if:                     

(i) the member is unable or refuses to submit an application for
disability retirement;

(ii) the Superintendent believes, the member to be permanently
physically or mentally incapable of performing assigned duties;

(iii) there is sufficient medical evidence in the form of a professional
opinion of an independent medical practitioner who has recognized expertise in the
diagnosis and treatment of the specified illness of the officer to' support the
Superintendent's determination of permanent disability;

(iv) the ONSET OF THE disability [has existed for] OCCURRED at
least 1 year EARLIER; and

(v) any administrative leave granted under Article 88B, § 23A of the
Code has expired.                                                                                   .                         

(3)     This subsection does not prevent an officer from exercising rights
granted under § 21-111(b) of this article.                                 

30-307.                                                                                                                      

[(e) On or after October 1, 1993:

(1) a participating employee is ineligible for the tax deferred annuity plan
established by the Board of Trustees of the Maryland Teachers and State Employees
Supplemental Retirement Plans under Title 35, Subtitle 4 of this article: and
