(2) (I) THE HOME HEALTH AGENCY SHALL SUBMIT THE REPORT OF
THE ACCREDITATION ORGANIZATION TO THE SECRETARY WITHIN 30 DAYS OF ITS
RECEIPT.
(II) ALL REPORTS SUBMITTED UNDER THIS PARAGRAPH SHALL BE
AVAILABLE FOR PUBLIC INSPECTION.
(3) THE SECRETARY MAY:
(I) INSPECT THE HOME HEALTH AGENCY FOR THE PURPOSE OF A
COMPLAINT INVESTIGATION OR TO VALIDATE FINDINGS OF THE ACCREDITATION
ORGANIZATION;
(II) INSPECT THE HOME HEALTH AGENCY TO FOLLOW UP ON A
SERIOUS PROBLEM IDENTIFIED IN AN ACCREDITATION ORGANIZATION'S REPORT;
AND
(III) ANNUALLY, CONDUCT A SURVEY OF UP TO 5 PERCENT OF ALL
HOME HEALTH AGENCIES IN THE STATE TO VALIDATE THE FINDINGS OF AN
ACCREDITATION ORGANIZATION'S REPORT.
[(d)](E) The provisions of this section do not waive the requirement for a home
health agency to obtain a certificate of need.
SECTION 2.—AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1991.
SECTION 2. AND BE IT FURTHER ENACTED, That by October 1, 1998 the
Department shall evaluate the effectiveness of this Act.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994. It shall remain effective for a period of 5 years and, at the end of
September 30, 1999, with no further action required by the General Assembly, this Act
shall be abrogated and of no further force and effect.

AN ACT concerning
State Board of Dental Examiners - Nomination Process
FOR the purpose of including the Maryland Academy of General Dentistry in a certain
nomination process; authorizing the Maryland State Dental Association and the
Maryland Dental Society, and the Maryland Dental Hygienists Association the
Maryland Academy of General Dentistry to mail notice regarding a meeting to
choose nominees for vacancies on the State Board of Dental Examiners to only
those licensed practitioners actively practicing in Maryland; and generally relating
