Ch. 3                                    1994 LAWS OF MARYLAND

(c)     A Class A-2 beer, wine and liquor off-sale package goods license authorizes
the holder to:

(1) Keep for sale and sell beer, wine, and liquor at retail; and

(2) Deliver alcoholic beverages in sealed packages or containers. The
package or container may not be opened nor its contents be consumed on the premises
where it is sold.

(d)     The annual license fee is $650.

(e)     A Class A-2 beer, wine and liquor off-sale license substituted under this
section may not be converted or substitute for any other class of alcoholic beverages
license, including a reversion to a Class B-D-7 beer, wine and liquor license.

(f)      A substitute license provided for under this section may not be granted after
May 1, 1993.

(g)     The hours during which the privileges conferred by this 6-day license may be
exercised are from 9 a.m. to 12 o'clock midnight Monday through Saturday.

(h) Notwithstanding the provisions of § 43 of this article, for purposes of zoning in
Baltimore City, the operation conducted by a holder of a Class A-2 beer, wine[,] and
liquor off-sale package goods license shall be considered to be that of a tavern.

19.

(a) (1) A Class B beer, wine and liquor license shall be issued by the license
issuing authority of the county in which the place of business is located, and the license
authorizes its holder to keep for sale and sell all alcoholic beverages at retail at any hotel
or restaurant at the place described, for consumption on the premises or elsewhere, or as
provided in this section.

(2)     The annual fee for this license is payable to the local collecting agent
before any license is issued, for distribution as provided in this article.

(3)     (i) Except in Montgomery County or in the case of a contrary
provision in this subtitle, this license shall be issued, on approval of the application by the
board of license commissioners in any county in which a license may be issued for the sale
of beer, [wine] WINE, and liquor, to the owner of any hotel which meets the following
minimum provisions:

1.       The hotel building shall be originally constructed for hotel
purposes; be at least three stories in height; and contain at least one passenger elevator.

2.       The hotel shall contain no less than 100 rooms for the
accommodation of the public.
