(3) TO HOLD A DANCE OR OTHER, FUNCTION AT WHICH PERSONS
UNDER AGE 21 MAY BE PRESENT. HOWEVER, IF THE DANCE OR OTHER FUNCTION IS
HELD,
(2) (I) ALCOHOLIC BEVERAGES MAY NOT BE SOLD AN© AT THE
FUNCTION NOR MAY ANY ALCOHOLIC BEVERAGES ON THE LICENSED PREMISES
SHALL BE SECURED BE PRESENT WITHIN THE ROOM WHERE THE FUNCTION IS
BEING HELD.
(II) THE SPONSOR OF THE FUNCTION SHALL PROVIDE APPROPRIATE
ADULT SUPERVISION AT THE FUNCTION.
[(h)](J) (1) [In Allegany County it shall be unlawful for any] A person [to]
MAY NOT display or [to] drink in any bar, restaurant, tavern or any other licensed place
any alcoholic beverages other than those which may lawfully be sold by the licensee
[therein] OF THE LICENSED PLACE.
(2) Any person who drinks or displays any such beverage in violation of the
provisions [hereof shall be deemed] OF THIS SUBSECTION IS guilty of a misdemeanor
and upon conviction [thereof] shall be fined not less than [$5.00] $25 nor more than
[$25.00] $50.
(3) For the purposes of this section, [the word] "premises" [shall be
construed to include] INCLUDES any building, parking lot, terrace or grounds which form
an integral part of the [said] licensed premises.
(4) Any premises licensed for the sale of beer only or for the sale of beer
and wine only shall have posted at least four conspicuous notices on the [said] premises
with the following words: "Unlawful to drink or expose liquor upon these premises."
[(i)] (K) Any licensee or other person, upon indictment and conviction of
violation of any provisions of this section, shall be fined [a sum] not [in excess of
$1,000.00] MORE THAN $1,000, or shall be [confined in the jail of Allegany County or in
the House of Correction of the State of Maryland for a period not to exceed]
IMPRISONED FOR UP TO 2 years, or [fined and imprisoned in the discretion of the
court] BOTH.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an emergency
measure, is necessary for the immediate preservation of the public health and safety, has
been passed by a yea and nay vote supported by three-fifths of all the members elected to
each of the two Houses of the General Assembly, and shall take effect from the date it is
enacted.
