Minors - Selling Deadly OR DANGEROUS Weapon to
406.                                       

(A)     It shall be unlawful for any person [, be he licensed dealer or not, ] to sell, barter
or give away TO ANY MINOR:

(1) [any] ANY firearms [whatsoever,] or other deadly weapons or [any]
ammunition [therefor, to any minor under the age of eighteen years ], except with the express
permission of a parent or guardian of [such ] THE minor; OR

(2) PEPPER MACE.

(B)     Any person violating this section shall on conviction [thereof] pay a fine of not
less than fifty nor more than two hundred dollars, together with the costs of prosecution [; and
upon ]. ON failure to pay [said] THE fine and costs, THE PERSON shall be committed to jail
and confined [therein 7 until such fine and costs are paid, or for the period of sixty days,
whichever shall first occur[, provided, however, that the].

(C)     THE provisions of this section [shall ] DO not apply to:

(1)      [a] A member of any organized militia in Maryland, when said member is
engaged in supervised training, marksmanship activities or any other performance of his
official duty [, and provided further that none of the restrictions or limitations contained herein
shall apply to ]; OR

(2)      [any] ANY adult or qualified supervisor or instructor of a recognized
organization engaged in the instruction of marksmanship.

(D)     IN THIS SECTION, "PEPPER MACE" MEANS AN AEROSOL PROPELLED
COMBINATION OF HIGHLY DISABLING IRRITANT PEPPER BASED PRODUCTS AND IS ALSO
KNOWN AS OLEORESIN CAPSICUM (O.C.) SPRAY.

(E)     IN THIS SECTION, "PEPPER MACE" MEANS AN AEROSOL PROPELLED
COMBINATION OF HIGHLY DISABLING IRRITANT PEPPER BASED PRODUCTS AND IS
ALSO KNOWN AS OLEORESIN CAPSICUM (O.C.) SPRAY.
