AN ACT concerning

Licensing and Certification - Standards and Inspections

FOR the purpose of clarifying and increasing the Department of Health and Mental
Hygiene's inspection authority of hospitals; requiring certain hospitals to submit
copies of survey findings of the Joint Commission on Accreditation of Health Care
Organizations to the Department and certain, other persons under certain
circumstances; specifying that certain reports and information are not discoverable
or admissible in civil actions; authorizing rather than requiring the referral of
certain complaints to certain hospitals; and generally relating to the Department of
Health and Mental Hygiene's Office of Licensing and Certification.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - General

19-308.

(a) The Secretary shall adopt reasonable rules and regulations that set standards
of services for related institutions and nonaccredited hospitals in the following areas:

(1)     The care of patients;

(2)     The medical supervision of patients;

(3)     The physical environment;

(4)     Disease control;

(5)     Sanitation;

(6)     Safety; and

(7)     Dietary matters.
