CHAPTER 353
(House Bill 1564)

AN ACT concerning

Kent County - State's Attorney's Office - Salary and Duties of Office

FOR the purpose of increasing the salary of the State's Attorney of Kent County;
•providing that the increase shall be implemented on a certain incremental basis;
providing that this Act does not apply to the salary of the incumbent State's
Attorney of Kent County; making the State's Attorney of Kent County a full-time
position; prohibiting the State's Attorney from engaging in the private practice of
law during the State's Attorney's term of office; permitting each deputy or assistant
State's Attorney of Kent County to engage in the private practice of law under
certain circumstances; and generally relating to the Kent County State's Attorney's
office.

BY repealing and reenacting, with amendments,
Article 10 - Legal Officials
Section 40(o)

Annotated Code of Maryland
(1990 Replacement Volume and 1993 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 10 - Legal Officials

40.

(o) In Kent County.

(1.) The State's Attorney shall receive an annual salary of [$47,500.]:

(I)      $55,000 IN 1994;

(II)     $56,250 IN 1995

(III)   $57,500 IN 1996

(IV)   $58,750 IN 1997; AND

(V)     $60,000 IN 1998 AND FOR EACH YEAR THEREAFTER.

(2) The State's Attorney may employ one or more deputy State's Attorneys
and assistant State's Attorneys who shall be members of the local bar in good standing.
The salaries of the deputy State's Attorneys and the assistant State's Attorneys shall be
set by the County Commissioners. The deputy State's Attorneys and the assistant State's
Attorneys shall serve at the pleasure of the State's Attorney.
