AN ACT concerning

Frederick County - Lighting of Public Ways

FOR the purpose of authorizing the Board of County Commissioners of Frederick County
to provide certain lighting in the County and to pay for the lighting from the general
revenues of the County; providing that a local authority may not place lighting along
or at an intersection with a State highway without prior written permission from the
State Highway Administration; and generally relating to the powers of local
authorities to regulate public lighting.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 11 - Frederick County

(A)     THIS SECTION SUPPLEMENTS THE AUTHORITY OF THE BOARD OF
COUNTY COMMISSIONERS TO PROVIDE LIGHTING UNDER ARTICLE 25, § 2B OF THE
ANNOTATED CODE OF MARYLAND.

(B)     SUBJECT TO § 25-102(B)(2) OF THE TRANSPORTATION ARTICLE. THE
BOARD OF COUNTY COMMISSIONERS MAY PROVIDE LIGHTING ALONG ALL OR ANY
PART OF THE STREETS, LANES, ALLEYS, AND PUBLIC WAYS OF THE COUNTY.

(C)     THE COSTS OF LIGHTING PROVIDED UNDER THIS SECTION MAY BE PAID
OUT OF THE GENERAL REVENUES OF THE COUNTY.
