(2) A HEALTH MAINTENANCE ORGANIZATION THAT IS LICENSED IN
THE STATE;
[(2)] (3) A third party administrator or any other entity under contract with
a Maryland business to administer health care benefits; of
[(3)] (4) A self-insured group.
19-1503.
(a) (1) The Commission shall consist of [seven] NINE members, SEVEN OF
WHOM ARE appointed by the Governor with the advice and consent of the Senate.
(2) Of the seven members APPOINTED BY THE GOVERNOR, four shall be
individuals who do not have any connection with the management or policy of a health
care provider or payor.
(3) THE SECRETARY AND THE INSURANCE COMMISSIONER SHALL BE
EX OFFICIO VOTING MEMBERS OF THE COMMISSION.
(b) (1) The term of a member is 4 years.
(2) A member who is appointed after a term has begun serves only for the
rest of the term and until a successor is appointed and qualifies.
(3) The Governor may remove a member for neglect of duty, incompetence,
or misconduct.
(4) A member may not servo more than two consecutive terms.
(c) To the extent practicable, when appointing members to the Commission, the
Governor shall assure geographic balance in the Commission's membership.
19-1504.
(A) The Governor shall appoint the chairman of the Commission.
(B) THE CHAIRMAN MAY APPOINT A VICE CHAIRMAN FOR THE COMMISSION.
19-1505.
(a) With the approval of the Governor, the Commission shall appoint an executive
director who shall be the chief administrative officer of the Commission.
(b) The executive director, THE DEPUTY DIRECTORS, AND THE PRINCIPAL
SECTION CHIEFS [serves] SERVE at the pleasure of the Commission.
(c) (1) The executive director, THE DEPUTY DIRECTORS, AND THE
PRINCIPAL SECTION CHIEFS shall be [an] unclassified [employee] EMPLOYEES.
(2) The Commission, in consultation with the Secretary, shall determine the
appropriate job classification and, subject to the State budget, the compensation for the
executive director, THE DEPUTY DIRECTORS, AND THE PRINCIPAL SECTION CHIEFS.
