Ch. 226                                    1994 LAWS OF MARYLAND

(5) Prior to the payment of any funds under the provisions of this Act for the
purposes set forth in Section 1(3) above, (a) the Howard County Arts Council shall
provide and expend a matching fund of $400,000, no part of which may be provided,
either directly or indirectly, from funds of Howard County, Maryland, and (b) the County
Executive and County Council of Howard County shall provide and expend a matching
fund of $400,000. No part of either matching fund may be provided, either directly or
indirectly, from funds of the State, whether appropriated or unappropriated. No part of
either matching fund, may consist of real properly, in kind contributions, or funds
expended prior to the effective date of this Act. In case of any dispute as to the amount
of the matching fund or what money or assets may qualify as matching funds, the Board
of Public Works shall determine the matter and the Board's decision is final. The County
Executive and County Council of Howard County and the Howard County Arts Council
have until June 1, 1996, to present evidence satisfactory to the Board of Public Works
that the matching funds will be provided. If satisfactory evidence is presented, the Board
shall certify this fact and the amount of each matching fund to the State Treasurer, and
the proceeds of the loan not exceeding the amount of either matching fund shall be
expended for the purposes provided in this Act. Any amount of the loan in excess of the
amount of either matching fund certified by the Board of Public Works shall be canceled
and be of no further effect.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 1994.

AN ACT concerning

Washington County—Hunting from Boats and Floating Blinds

FOR the purpose of allowing hunting for certain waterfowl from boats and floating blinds
in certain waters of Washington County the Potomac River in certain counties;
altering a certain distance restrictions on hunting from boats or floating blinds in
certain waters; altering certain dates for licensing blind sites in certain waters;
altering certain certifications required of certain riparian owners and other persons;
and generally relating to hunting, boats and floating blinds, and waters of
Washington County the State.

BY repealing and reenacting, with amendments,
