of the matching fund shall be expended for the purposes provided in this Act. Any
amount of the loan in excess of the amount of the matching fund certified by the Board
of Public Works shall be canceled and be of no further effect.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 1994.

AN ACT concerning

Public Service Commission - Underground Facilities - Fees

FOR the purpose of clarifying the provision granting authority to a political subdivision or
municipality to charge, assess, or collect from a contractor a certain fee that is fees
incurred in connection with the underground storage facilities of certain public
service companies; and generally relating to the establishment of certain authority
of a political subdivision or municipality regarding the collection of certain fees in
connection with certain underground storage facilities of public service companies.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 78 - Public Service Commission Law

28A.

(a)     It is the intent of the legislature to protect underground facilities of public
service companies from destruction, damage or dislocation in order to prevent:

(1) Death or injury to persons.

             (2) Property damage to private and public property.

            (3) Loss of services of public service companies to the general public.                                                             

(b)     As used in this subtitle;

(1) (i) "Contractor" means a person who performs excavation or
