Ch. 184                                    1994 LAWS OF MARYLAND

(viii) Applies to renew a tidal fish license to provide services as a
fishing guide under § 4-210 of this title in the Atlantic Ocean, its seaside bays, and their
tidal tributaries, including a license on inactive status that was valid on September 1,
1993.

(b)     Unless an applicant complies with the provisions of this section, the
Department may not issue a new fishing license:

(1)     After September 1, 1988, to catch crabs for sale, finfish, oysters, or
clams;

(2)     After September 1, 1992, to provide services as a fishing guide under §
4-210 of this title in the tidal waters of the Chesapeake Bay and its tributaries; or

(3)     After September 1, 1993 to provide services as a fishing guide under §
4-210 of this title in the Atlantic Ocean, its seaside bays, and their tributaries.

(c)     Before the Department may issue to a person a new tidal fish license, the
person must:                                                        ..

(1)     Register with the Department on a form provided by the Department at
least 2 years before the year of license issuance;

(2)     Supply verifiable evidence of any federal license that is issued in the
applicant's name by the U.S. Coast Guard to operate a vessel carrying passengers for hire;
and

(3)     Pay all applicable tidal fish license fees set under § 4-701 of this subtitle
at the time of registration.

(d)     An applicant is not required to pass a test to obtain a new tidal fish license
under this section.]

A person may be licensed to utilize a restricted gill net for noncommercial fishing in
the tidal waters of the State, upon application and payment of a fee. The licensee may fish
a single staked gill net, not to exceed 50 yards in length in the Chesapeake Bay and its
tidal tributaries and 100 yards in length in the tidal waters of Worcester County that are
not tributaries of the Chesapeake Bay and not to be used for commercial purposes. The
use of nets fished under the provisions of this section is subject to every law and every rule
or regulation governing net fishing. The Department may adopt rules and regulations
governing use of gill nets fished under the provisions of this section in any of the waters
of the State, restricting the use of gill nets in any waters deemed necessary for
conservation purposes, and regulating the quantities of any species of fish caught by gill
nets.]

4-713.

(a) A person who fishes with haul seine equipment shall carry a [haul seine rig
license] TIDAL FISH LICENSE TO CATCH FINFISH.
