Ch. 184                                        1994 LAWS OF MARYLAND

(iv) Persons who are State residents over 64 years of age who have held
a tidal fish license each year for at least 3 years before their 64th birthday to harvest
finfish for commercial purposes using not more than 1 boat;

(v) Persons who are State residents under 14 or over 64 years of age
for finfish and crab harvesting for personal consumption pursuant to §§ 4-709 and
4-804(c); and

(vi) Persons who are State residents over 64 years of age to harvest
soft-shell clams or hard-shell clams with equipment that is lawful under Subtitle 10 of
this title.

(5) (i) Except as provided in this paragraph, a person may not transfer or
loan a license that is issued under paragraph (4) of this subsection.

(ii) If a licensee is unable to fish due to illness and the Natural
Resources police approves a transfer of a license issued under paragraph (4) of, this
subsection, a licensee may transfer the license for not more than 10 days.]

[(e) (1) (i) A person shall apply for a new or renewed tidal fish license on the
appropriate form provided by the Department and shall submit with the application the
annual fee for each activity for which a license is sought.]

(B)      (1) THE DEPARTMENT SHALL UTILIZE A SINGLE, COMMERCIAL
LICENSE, TO BE KNOWN AND DESIGNATED AS A TIDAL FISH LICENSE.

(2)      A TIDAL FISH LICENSE AUTHORIZES A LICENSEE:

(I)       TO ENGAGE IN EACH ACTIVITY INDICATED ON THE LICENSE;
AND

(II)     FOR CATCHING CRABS, TO UTILIZE THE NUMBER OF CREW
MEMBERS INDICATED ON THE LICENSE.

(3)      THE DEPARTMENT MAY NOT ISSUE A TIDAL FISH LICENSE TO, AND A
LICENSE MAY NOT BE HELD BY, AN INDIVIDUAL WHO IS YOUNGER THAN 12 YEARS
OF AGE.

(4)      A PERSON MAY NOT GUIDE FISHING PARTIES OR CATCH, SELL, BUY,
PROCESS, TRANSPORT, EXPORT, OR OTHERWISE DEAL IN FISH CAUGHT IN TIDAL
WATERS UNLESS LICENSED UNDER THIS SECTION.

(C)      (1) THE LICENSE YEAR FOR EVERY TIDAL FISH LICENSE SHALL BE 12
MONTHS FROM SEPTEMBER 1 THROUGH AUGUST 31 OF THE FOLLOWING YEAR.

(2) A LICENSEE AND CREW MEMBERS MAY ENGAGE ONLY IN THOSE
ACTIVITIES FOR WHICH THE ANNUAL FEES FOR THAT LICENSE YEAR HAVE BEEN
PAID.

(D)     (1) THE DEPARTMENT MAY ISSUE NO MORE THAN ONE
AUTHORIZATION TO A PERSON TO ENGAGE IN EACH ACTIVITY UNDER PARAGRAPH
(2)(II)1 AND 2 OF THIS SUBSECTION DURING A LICENSE YEAR.
