SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.

AN ACT concerning
Residential Service Agencies - Home Medical Equipment Providers
FOR the purpose of requiring a person to be licensed with the Department of Health and
Mental Hygiene as a residential service agency before the person may provide home
medical equipment services; restricting the licensure requirement to certain
persons; requiring the Department to adopt certain regulations; requiring that the
regulations include minimum standards; requiring the Secretary Department to set
certain fees to cover the costs of licensure; authorizing the Department to
determine compliance with certain regulations and to approve, deny, suspend, or
revoke licensure; providing penalties for noncompliance; providing that this Act
does not entitle a person to third party reimbursement; providing for certain
exceptions; defining certain terms; and generally relating to residential service
agencies that provide home medical equipment providers.

WHEREAS, The staff of the Maryland Health Resources Planning Commission
has prepared a report entitled "Study of Community Based Long Term. Care Services,
Part I; Home Care Services, November 30, 1993," and concluded that providers of
noninvasive home medical equipment services are not presently regulated in Maryland;
