Ch. 115                                        1994 LAWS OF MARYLAND

Chapter 436 of the Acts of 1990

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That:

(3) The cash proceeds of the sale of the bonds shall be paid to the Treasurer and
first shall be applied to the payment of the expenses of issuing, selling, and delivering the
bonds, unless funds for this purpose are otherwise provided, and then shall be credited on
the books of the Comptroller and expended, on approval by the Board of Public Works,
for the following public purposes, including any applicable architects' and engineers' fees:
as a grant to the County Executive and County Council of Anne Arundel County to [be
used for the design, construction, and equipping of an addition to the Anne Arundel
County Detention Center in Annapolis [.]; AND] PROVIDE A PORTION OF THE FUNDS
FOR THE DESIGN, CONSTRUCTION, AND EQUIPPING OF:

(A) A NEW ANNE ARUNDEL COUNTY DETENTION CENTER ANNEX AT THE
ORDNANCE ROAD SITE IN GLEN BURNIE; AT A SITE SELECTED BY THE GOVERNING
BODY OF ANNE ARUNDEL COUNTY; COUNTY BY OCTOBER 1, 1994. FAILURE TO SPECIFY
AN ALTERNATIVE SITE BY THAT DATE SHALL RESTRICT THE SITE TO ORDNANCE ROAD
IN GLEN BURNIE; AND,

(B) THE RENOVATION, RECONSTRUCTION, AND UPGRADING OF THE
EXISTING ANNE ARUNDEL COUNTY DETENTION CENTER IN ANNAPOLIS; AND.

(C) PROVIDED THAT NO FUNDS UNDER THIS CHAPTER MAY BE USED FOR
THE CONSTRUCTION OF A NEW ANNE ARUNDEL COUNTY DETENTION CENTER
ANNEX AT THE ORDNANCE ROAD SITE UNTIL THE NUCLEAR REGULATORY
COMMISSION PROVIDES A LETTER STATING THAT THE CLEANUP LEVELS ACHIEVED
ON THE SITE OF THE NEW DETENTION CENTER MEET THEIR REQUIREMENTS AND
THE AREA ON WHICH THE DETENTION CENTER IS TO BE BUILT IS OPEN TO
UNRESTRICTED USE.

(6) PROVIDED THAT NO FUNDS UNDER THIS CHAPTER MAY BE USED FOR THE
CONSTRUCTION OF A NEW ANNE ARUNDEL COUNTY DETENTION CENTER ANNEX AT THE
ORDNANCE ROAD SITE UNTIL THE NUCLEAR REGULATORY COMMISSION PROVIDES A
LETTER STATING THAT THE CLEANUP LEVELS ACHIEVED ON THE PROPOSED
ORDNANCE ROAD SITE OF THE NEW DETENTION CENTER MEET THEIR REQUIREMENTS
AND THE AREA ON WHICH THE DETENTION CENTER COULD BE BUILT IS OPEN TO
UNRESTRICTED USE.

SECTION 2. AND BE IT FURTHER ENACTED, THAT ANNE ARUNDEL COUNTY SHALL
BE REQUIRED TO SUBMIT A REPORT TO THE BUDGET COMMITTEES OUTLINING
CURRENT USE OF ALTERNATIVE TO INCARCERATION PROGRAMS, PLANS TO EXPAND THE
USE OF SUCH PROGRAMS AND THE RESULTANT SAVINGS IN PROJECTED BED NEEDS.

SECTION [2.] 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 1990.

SECTION 1. AND BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That:
