Ch. 113

(1) THE STATE HAS PAID FOR COVERED EXPENSES UNDER THE
MARYLAND MEDICAL ASSISTANCE PROGRAM FOR MEDICAL CARE SERVICES
PROVIDED TO AN ELIGIBLE INDIVIDUAL; AND

(2) THE HEALTH CARE SERVICES PROVIDED UNDER THE MARYLAND
MEDICAL ASSISTANCE PROGRAM ARE ALSO INCLUDED UNDER THE INDIVIDUAL'S
HEALTH INSURANCE COVERAGE PROVIDED BY THE INSURER.

(D) AN INSURER SHALL NOT IMPOSE REQUIREMENTS ON A STATE AGENCY,
WHICH HAS BEEN ASSIGNED THE RIGHTS OF AN INDIVIDUAL ELIGIBLE FOR
MEDICAL ASSISTANCE AND WHO HAS HEALTH INSURANCE COVERAGE FROM THE
INSURER, THAT ARE DIFFERENT FROM REQUIREMENTS APPLICABLE TO AN AGENT
OR ASSIGNEE OR ANY OTHER INDIVIDUAL SO COVERED.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland

5-1011.

(A)     IN THIS SECTION, "ADMINISTRATION" MEANS THE CHILD SUPPORT
ENFORCEMENT ADMINISTRATION OF THE DEPARTMENT OF HUMAN RESOURCES.

(B)     THE ADMINISTRATION SHALL BE THE COMPLAINANT ON BEHALF OF A
PERSON THE ADMINISTRATION HAS APPROVED FOR CHILD SUPPORT SERVICES OR
ON BEHALF OF A PERSON WHO HAS MADE AN ASSIGNMENT UNDER ARTICLE 88A, §
48(2) OF THE CODE.

[(a)](C) (1) [If the complainant is the Administration, or a person approved
for child support services by the Administration, the complainant]
THE
ADMINISTRATION shall be represented by:

[(1)](I) the Attorney General;

[(2)](II) the State's Attorney, if the State's Attorney has assumed the
r
esponsibility for representation under Title 10, Subtitle 1 of this article; or

[(3)](III) a qualified lawyer representing the Administration who is
appointed by and subject to supervision and removal by the Attorney General.

(2) REPRESENTATION OF THE ADMINISTRATION BY AN ATTORNEY
UNDER PARAGRAPH (1) OF THIS SUBSECTION:

(I) CREATES AN ATTORNEY CLIENT RELATIONSHIP BETWEEN
THAT ATTORNEY AND THE ADMINISTRATION; AND

(II) DOES NOT CREATE AN ATTORNEY CLIENT RELATIONSHIP
BETWEEN THAT ATTORNEY AND ANY OTHER PARTY.

[(b)](D) For purposes of providing legal representation in a paternity proceeding
under this section, the Administration may approve child support services for a person
who resides out of state.
