Ch. 113                                        1994 LAWS OF MARYLAND

(1)     REPRISAL AGAINST A PARENT;

(2)     DISMISSAL OF A PARENT FROM EMPLOYMENT; OR

(3)     REFUSAL TO HIRE OR TO PROMOTE A PARENT.

(K) AN ORDER ENTERED UNDER THIS SECTION IS BINDING ON A PRESENT
AND FUTURE EMPLOYER OF THE PARENT ON WHOM A COPY OF THIS ORDER IS
SERVED.

Article - Health - General

15-109.

(d) As a condition of eligibility for medical assistance, a recipient is deemed to
hav
e assigned to the Secretary of Health and Mental Hygiene or the Secretary's designee
any rights to [medical care support as determined by a court of administrativ
e order and
any rights to payment for medical care from health insurance as d
efined in Article 48A, §
66 of the Code] PAYMENT FOR MEDICAL CARE SERVICES FROM ANY THIRD PARTY

WHO HAS THE LEGAL LIABILITY TO MARE PAYMENTS FOR THOSE SERVICES, TO THE
EXTENT. OF ANY PAYMENTS MADE BY THE DEPARTMENT ON. BEHALF OF THE
RECIPIENT.

Article 48AInsurance Code

490W.

(A) (1) IN THIS SECTION THE FOLLOWING TERMS HAVE THE MEANINGS
INDICATED:

(2) "COURT OR ADMINISTRATIVE ORDER" MEANS AN ORDER ISSUED
BY A COURT OR ADMINISTRATIVE AGENCY THAT:

                         (I) CREATES OR RECOGNIZES THE RIGHT OF A CHILD TO RECEIVE

BENEFITS UNDER A PARENT'S HEALTH INSURANCE COVERAGE;

(II) CLEARLY DESCRIBES THE COVERAGE TO BE PROVIDED; AND

(III) SPECIFIES THE PERIOD OF TIME TO WHICH THE ORDER
APPLIES.

(3) "HEALTH INSURANCE COVERAGE" MEANS ANY TYPE OF HEALTH
CARE COVERAGE UNDER WHICH MEDICAL CARE SERVICES CAN BE PROVIDED TO
THE CHILD THROUGH AN INSURER.

(4) "INSURER" MEANS;

(I) A COMMERCIAL INSURER, A NONPROFIT HEALTH SERVICE
ORGANIZATION, OR A HEALTH MAINTENANCE ORGANIZATION OPERATING IN THIS
STATE UNDER A CERTIFICATE OF AUTHORITY ISSUED BY THE MARYLAND
INSURANCE COMMISSIONER;

(II) A GROUP HEALTH PLAN, AS DEFINED IN § 607(1) OF THE
EMPLOYEE RETIREMENT INCOME SECURITY ACT OF 197
