[(a)] (B) Each year, the Administration may certify to the State Comptroller any
obligor who is in arrears of support payments amounting to more than $150 under the
court order, if:
(1) the Administration has accepted an assignment of support under Article
88A, § 48(2) of the Code; or
(2) the recipient of support payments has filed an application for support
enforcement services with the Administration.
(C) (1) EACH YEAR THE ADMINISTRATION OR THE DEPARTMENT OF
HEALTH AND MENTAL HYGIENE MAY CERTIFY TO THE STATE COMPTROLLER ANY
OBLIGOR WHO PROVIDES HEALTH INSURANCE FOR A CHILD AND RECEIVES A
HEALTH INSURANCE PAYMENT FROM THE INSURER AND DOES NOT USE THE
HEALTH INSURANCE PAYMENT TO REIMBURSE THE OTHER PARENT, GUARDIAN OF
THE CHILD, OR THE HEALTH CARE PROVIDER TO THE EXTENT NECESSARY TO
REIMBURSE THE DEPARTMENT FOR THE AMOUNT EXPENDED FOR MEDICAL COSTS.
(2) THE CERTIFICATION MAY BE UP TO THE AMOUNT OF MEDICAID
EXPENDITURES FOR THE CHILD IF THE STATE HAS ACCEPTED AN AUTOMATIC
ASSIGNMENT OF BENEFITS UNDER § 15-109(D) OF THE HEALTH GENERAL ARTICLE.
[(b)](D) The Administration OR THE DEPARTMENT shall notify the obligor that:
(1) a certification has been made by the Administration OR THE
DEPARTMENT; and
(2) the obligor may ask the Administration OR THE DEPARTMENT, AS
APPROPRIATE, to investigate the arrearage OR CONVERTED FUNDS.
[(c)] (E) The certification shall include, if known:
(1) the full name of the obligor, and any other names known to be used by
the obligor;
(2) the address and the Social Security number of the obligor; and
(3) the amount of the arrearage OR CONVERTED FUNDS.
[(d)](F) (1) On receipt of notice of certification, any obligor who disputes the
existence or amount of the arrearage OR CONVERTED FUNDS may ask the
Administration OR THE DEPARTMENT to investigate the arrearage OR CONVERTED
FUNDS.
(2) On receipt of a request for investigation from the obligor, the
Administration OR THE DEPARTMENT shall:
(i) conduct an investigation as to the accuracy of the reported
arrearage OR CONVERTED FUNDS; and
(ii) if the Administration OR THE DEPARTMENT finds that there is an
error, correct the amount of the reported arrearage OR CONVERTED FUNDS or withdraw
the certification.
