SECTION 2. AND BE IT FURTHER ENACTED, That if any provisions of this
Act or the application thereof to any person or circumstance is held invalid for any reason
in a court of competent jurisdiction, the invalidity does not affect other provisions or any
other application of this Act which can be given effect without the invalid provision or
application, and for this purpose the provisions of this Act are declared severable.
SECTION 3. AND BE IT FURTHER ENACTED, That the Comptroller shall
deposit one half of any fines collected under Section 1 into the General Fund of the
State, and one half of the fines collected under this section shall be retained by the
county or Baltimore City where any affected cigarette license was issued.
SECTION 4. 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 1994.

AN ACT concerning
Maryland Tourism Development -- Funding
FOR the purpose of requiring the Comptroller to distribute a portion of the sales and use
tax revenue providing that the Governor should requiring the Governor to include in
the annual Budget Bill for certain fiscal years certain minimum appropriations to
the Maryland Tourism Development Board Fund; restricting to certain purposes
the use of certain amounts distributed to the Fund requiring the Governor to make
a certain report under certain circumstances; requiring allowing the Governor to
include in the annual Budget Bill for certain fiscal years certain minimum general
funds appropriations for tourism development in the Department of Economic and
Employment Development; requiring a certain portion of the budget of the Office
of Tourism Development to be spent for certain purposes; restricting the use of
certain funds appropriated to the Office; providing for the intent of this Act;
requiring certain annual reports to the Legislative Policy Committee of the General
Assembly; providing for the termination of this Act; and generally relating to the
Maryland Tourism Development Board Fund and the funding of tourism
development in the State.
