Ch. 20

[(c) An emergency employee is entitled to benefits under the Maryland Workers'
Compensation Act, but is not eligible for membership in any retirement or pension system
under Article 73B of the Code.]

13-106.

A person may not use or promise to use the person's influence or official authority
to secure an appointment to a classified service position or an opportunity for an
appointment to a classified service position in exchange or as a reward for personal
service or [partisan] political service.

13-107.

An employee or public [officer] OFFICIAL of this State may not use a threat or
coercion to induce or attempt to induce a classified service employee:

(1)     to resign;

(2)     to take a leave of absence; or

(3)     to waive a right granted by this Division I.

Article 73B - Pensions

[1-508.

(a)     For purposes of determining retirement benefits under this article, each
classified service employee in the State Personnel Management System who terminates
employment on or after July 1, 1990 for reasons other than retirement shall forfeit any
accumulated sick leave.

(b)     Upon termination before July 1, 1990, or upon termination by retirement on
or after July 1, 1990, each classified service employee is entitled to have accumulated sick
leave days added to the employee's creditable service for the purposes of determining
retirement benefits under this article.

(c)     A State employee who came into the State system while retaining sick leave
and annual leave benefits under a county system and who came under the provisions of
Chapter 423, Acts of 1971, shall be entitled to the same full credit toward retirement as
provided by this section.]

3-302.

(F) A STATE EMPLOYEE WHO CAME INTO THE STATE SYSTEM WHILE
RETAINING SICK LEAVE AND ANNUAL LEAVE BENEFITS UNDER A COUNTY SYSTEM
AND WHO CAME UNDER THE PROVISIONS OF CHAPTER 423 OF THE ACTS OF 1971
SHALL BE ENTITLED TO THE SAME FULL CREDIT TOWARD RETIREMENT AS
PROVIDED BY THIS SECTION.
