Article - State Personnel and Pensions

DIVISION I. STATE PERSONNEL
1-101.

(e) (2) "Contractual employee" does not include an individual who is employed
as:

(i)      a classified service employee;

(ii)    an unclassified service employee;

(iii)   an emergency employee; OR

(iv)    a temporary extra employee[; or

(v)     a temporary pending employee].

(k) "Reinstate" means[, unless the context requires otherwise,] to reemploy an
individual [in a class to which the individual previously belonged,] with restoration of all
benefits.

1-203.

(a) Except as provided in this section or otherwise by law, all positions in the
executive branch of State government are in the State Personnel Management System,
including all classified service, unclassified service, full-time, part-time, permanent,
temporary extra, [temporary pending,] emergency, and contractual employees.

[Except for the positions in the District Court of Maryland that are listed in § 1-302
of this title, all] ALL positions in the judicial branch of State government are-excluded
from the State Personnel Management System EXCEPT:

(1)     THE POSITIONS IN THE DISTRICT COURT OF MARYLAND THAT ARE
LISTED IN § 1-302 OF THIS TITLE; OR

(2)      AS OTHERWISE PROVIDED BY LAW.

The following employees are in neither the classified service nor unclassified
service:

(1)     a contractual employee;

(2)     an emergency employee; OR

(3)     a temporary extra employee [; or

(4)     a temporary pending employee].
