Article 16A - Maryland Emergency Management Agency
4.
(a) (1) There is a Maryland Emergency Management Agency IN THE
MILITARY DEPARTMENT.
(2) (I) The Adjutant General shall, with the approval of the Governor,
appoint a Director of the Maryland Emergency Management Agency who shall be the
executive head of the Agency. [The Maryland Emergency Management Agency shall be
part of the Military Department.]
(II) The Director IS IN THE UNCLASSIFIED SERVICE OF THE STATE
PERSONNEL MANAGEMENT SYSTEM AND shall hold office [during] AT the pleasure of
the Adjutant General[, and].
(III) THE DIRECTOR shall receive such salary as is provided in the
budget.
(b) (1) Subject to the authority of the Adjutant General, the Director may
employ professional, technical, clerical, stenographic, and other personnel within the
appropriations and (except as to the position of Director) subject to the conditions and
limitations [contained in Article 64A of the Annotated Code of Maryland,] OF THE
STATE PERSONNEL ARTICLE THAT GOVERN THE CLASSIFIED SERVICE.
(2) [and the] THE Director may make [such] expenditures within the
appropriations[,] or from other funds made available to [him] THE DIRECTOR for
purposes of emergency management, as may be necessary[,] to carry out the purposes of
this subtitle.
(c) The Director is responsible to the Governor and the Adjutant General for
carrying out the State emergency management program. On those occasions when the
Governor shall have formally declared the threat or existence of a State emergency, the
Director shall coordinate the activities of all organizations for emergency management
operations within the State. [He] THE DIRECTOR shall maintain liaison with and
cooperate with emergency management agencies and organizations of other states and of
the federal government.

substantive change former Art. 64A, § 9B, and to make stylistic changes.
