Ch. 10

1993 LAWS OF MARYLAND

SUBTITLE 6. RESIGNATIONS.

9-601. REGULATIONS BY SECRETARY.

THE SECRETARY SHALL ADOPT REGULATIONS TO GOVERN RESIGNATIONS BY
CLASSIFIED SERVICE EMPLOYEES.

.. REVISOR'S. NOTE: This section is new language derived without substantive
change from former Art. 64A, § 33(a)(2).

The reference to "classified service employees" is added for clarity.

Defined terms: "Classified service" § 1-101
"Secretary" § 1-101

9-602. RESIGNATION BEFORE APPOINTMENT VOID.

ANY RESIGNATION FROM A CLASSIFIED SERVICE POSITION IS VOID IF THE
RESIGNATION, WHETHER DATED OR UNDATED, IS SIGNED BEFORE THE DAY OF
APPOINTMENT TO THAT POSITION.

REVISOR'S NOTE: This section is new language derived without substantive
change from the fifth and sixth sentences of former Art. 64A, § 40.

This section is rephrased to clarify that a resignation before appointment is
void, rather than to state a prohibition against signing the resignation.

The former phrase "or execute" is deleted as unnecessary in light of the broad
reference to the resignation being "signed".

Defined terms: "Classified service" § 1-101
"Position" § 1-101

GENERAL REVISOR'S NOTE TO TITLE:

Former Art. 64A, § 33(a)(1), which listed the various ways that classified service
employees may separate from employment, is deleted as encompassed in the substantive
provisions of this title governing those separations.

The provisions of former Art. 64A, § 33(d)(2), which expressly apply separation
procedures to demotions, now appear at § 4-604 of this article.

TITLE 10. GRIEVANCE PROCEDURES.

SUBTITLE 1. DEFINITIONS; GENERAL PROVISIONS.

10-101. "GRIEVANCE" DEFINED.

IN THIS TITLE, "GRIEVANCE" MEANS A DISPUTE BETWEEN AN EMPLOYEE AND
THE EMPLOYEE'S EMPLOYER ABOUT THE INTERPRETATION OF AND APPLICATION
TO THE EMPLOYEE OF:

(1) A PERSONNEL POLICY OR REGULATION ADOPTED BY THE
