SUBTITLE 4. DISCIPLINARY SUSPENSIONS.
9-401. SCOPE OF SUBTITLE.

(A)     EMPLOYEES COVERED.

THIS SUBTITLE APPLIES ONLY TO CLASSIFIED SERVICE EMPLOYEES.

(B)      EXCEPTION.

THIS SUBTITLE DOES NOT APPLY TO A SUSPENSION PENDING THE DISPOSITION
OF A CHARGE FOR REMOVAL OF A CLASSIFIED SERVICE EMPLOYEE.

REVISOR'S NOTE: Subsection (a) of this section is new language added for
clarity and to conform to long-standing Departmental understanding and
administrative practice.

Subsection (b) of this section is new language derived without substantive
change from the introductory language of former Art. 64A, § 55(f).
Suspensions pending disposition of charges for removal are governed by
Subtitle 3 of this title.

9-402. SUSPENSION ALLOWED.

(A)     IN GENERAL.

AN APPOINTING AUTHORITY MAY SUSPEND A CLASSIFIED SERVICE EMPLOYEE
FOR DISCIPLINARY PURPOSES.

(B)      NOTICE REQUIRED.

THE APPOINTING AUTHORITY SHALL NOTIFY THE EMPLOYEE IN WRITING OF
THE SUSPENSION AND THE REASONS FOR IT.

(C)      SUSPENSIONS TO BE WITHOUT PAY.

A SUSPENSION FOR DISCIPLINARY PURPOSES UNDER THIS SUBTITLE SHALL BE
WITHOUT PAY.

REVISOR'S NOTE: Subsections (a) and (c) of this section are new language
derived without substantive change from the first sentence and the first clause
of the second sentence of former Art. 64A, § 36.

Subsection (b) of this section is new language added to conform to a similar
requirement in § 9-302(b) of this title and to COMAR 06.01.01.46.
