(2) EACH ADDITIONAL 5 YEARS OF SERVICE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 64A, § 32.

The former requirement that a certificate be "written" is deleted as
superfluous.

Also, the former phrase "including but not limited to those teachers and other
instructional employees who are employed by or in institutions of the State
departments of correction, welfare, health and mental hygiene" is deleted as
unnecessary in light of § 8-301 of this subtitle.

TITLE 9. SEPARATIONS.

SUBTITLE 1. REJECTIONS DURING PROBATION.

9-101. SCOPE OF SUBTITLE.

THIS SUBTITLE APPLIES ONLY TO CLASSIFIED SERVICE EMPLOYEES.

REVISOR'S NOTE: This section is new language added for clarity.

Unclassified service employees serve at the pleasure of the appointing
authority and do not have probation periods set by statute or regulation.

Defined term: "Classified service" § 1-101

9-102. REJECTIONS ALLOWED.

(A)     IN GENERAL.

EXCEPT AS PROVIDED IN § 9-103 OF THIS SUBTITLE, AN APPOINTING
AUTHORITY MAY REJECT A CLASSIFIED SERVICE EMPLOYEE AT ANY TIME DURING
PROBATION BY NOTIFYING THE SECRETARY IN WRITING OF THE REJECTION AND
THE REASON FOR IT.

(B)     EFFECT OF REJECTION.

WHEN REJECTED, THE EMPLOYEE IS PERMANENTLY SEPARATED FROM THE
POSITION.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first clause of former Art. 64A, § 33(b)(1)(i) and the first
clause of § 33(b)(1)(ii).
