Ch. 10

AN INDIVIDUAL MAY ENROLL AND PARTICIPATE IN THE HEALTH INSURANCE
BENEFIT OPTIONS ESTABLISHED UNDER THE PROGRAM IF THE INDIVIDUAL:

(1)      RETIRED UNDER AN OPTIONAL PROGRAM UNDER TITLE 11 OF
ARTICLE 73B OF THE CODE; AND

(2)      WAS IN SERVICE WITH A STATE INSTITUTION OF HIGHER
EDUCATION AT THE TIME OF THE RETIREMENT.

(B) STATE SUBSIDY.

AN ENROLLEE UNDER THIS SECTION IS ENTITLED TO THE SAME STATE
SUBSIDY ALLOWED A RETIREE UNDER § 8-108 OF THIS SUBTITLE. HOWEVER, THE
SUBSIDY SHALL APPLY ONLY TO THE COSTS OF COVERAGE FOR THE ENROLLEE AND
MAY NOT APPLY TO ANY ADDITIONAL COSTS OF COVERAGE FOR THE ENROLLEE'S
SPOUSE OR CHILDREN.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 64A, § 48C(a) and (b).

In subsection (a)(1) of this section, the reference to an "optional program" is
added for clarity and to distinguish the individual who retires under this
section from a retiree under § 8-108 of this subtitle.

In subsection (a)(2) of this section, the phrase "of higher education" is added
to modify "State institution" for clarity.

Former Art. 64A, § 48C(c), which allowed participation by a "spouse or the
children" only if the employee paid the cost, is deleted as unnecessary. The
scope of coverage available to employees with optional retirement may include
family members, even though the "subsidy" only applies to individual
coverage.

8-110. SAME — LOCAL GOVERNMENT EMPLOYEES.

(A)     WHO MAY ENROLL.

AN EMPLOYEE OF A COUNTY OR MUNICIPAL CORPORATION MAY ENROLL AND
PARTICIPATE IN THE HEALTH INSURANCE BENEFIT OPTIONS ESTABLISHED UNDER
THE PROGRAM WITH THE APPROVAL OF THE GOVERNING BODY OF THE COUNTY
OR MUNICIPAL CORPORATION.

(B)      PAYMENT OF COSTS.

THE GOVERNING BODY OF THE COUNTY OR MUNICIPAL CORPORATION SHALL:

(1)      PAY TO THIS STATE THE TOTAL COSTS RESULTING FROM THE
PARTICIPATION OF ITS EMPLOYEES IN THE PROGRAM; AND

(2)      DETERMINE THE EXTENT TO WHICH THE COUNTY OR MUNICIPAL
CORPORATION WILL SUBSIDIZE PARTICIPATION BY ITS EMPLOYEES IN THE
PROGRAM.
