(1)      ARE ELIGIBLE TO ENROLL AND PARTICIPATE IN THE PROGRAM
WITH STATE SUBSIDIES;

(2)      ARE ELIGIBLE TO ENROLL AND PARTICIPATE IN THE PROGRAM
WITHOUT STATE SUBSIDIES; AND

(3)      ARE NOT ELIGIBLE TO ENROLL OR PARTICIPATE IN THE PROGRAM.

REVISOR'S NOTE: Subsections (a) and (b) of this section are new language
derived without substantive change from former Art. 64A, § 48(a)(2)(i) and
(3), the third clause of § 48(a)(1), and § 48A(b).

Subsection (c) of this section is new language added to clarify the Secretary's
authority to determine employee eligibility, reflecting COMAR 06.01.07.03
and 06.01.07.05.

In subsection (a)(1) of this section, the former reference to "effective and
efficient" administration is deleted as surplusage.

In subsection (a)(3) of this section, the former phrase "for inclusion in the
budget" is deleted as unnecessary because the Governor is required by §
8-104 of this subtitle to include amounts in the State budget for costs of the
Program.

8-104. INCLUSION OF STATE SHARE OF COSTS IN BUDGET.

EACH YEAR THE GOVERNOR SHALL INCLUDE MONEY IN THE STATE BUDGET
TO PAY THE STATE SHARE OF THE COSTS OF THE PROGRAM.

8-105. HEALTH INSURANCE ADVISORY COUNCIL — ESTABLISHMENT AND
MEMBERSHIP.

(A)     COUNCIL ESTABLISHED.

THERE IS A STATE EMPLOYEES' HEALTH INSURANCE ADVISORY COUNCIL.

(B)     MEMBERSHIP.

THE ADVISORY COUNCIL CONSISTS OF THE FOLLOWING 11 MEMBERS:

(1)      THE SECRETARY OR A DESIGNEE OF THE SECRETARY; AND

(2)      A REPRESENTATIVE OF EACH OF THE FOLLOWING, APPOINTED BY
THE GOVERNOR:

(I) THE DEPARTMENT OF BUDGET AND FISCAL PLANNING;
