7-1003. UNPAID LEAVES OF ABSENCE.

THE SECRETARY MAY PROVIDE BY REGULATION FOR LEAVES OF ABSENCE
WITHOUT PAY FOR UP TO 2 YEARS.

REVISOR'S NOTE: This section is new language derived from former Art. 64A, §
37D(1).

The former reference to "State" employees is deleted as unnecessary in light
of § 7-1001 of this subtitle.

As to the phrase "may provide by regulation", see Revisor's Note to § 7-1002
of this subtitle.

GENERAL REVISOR'S NOTE TO TITLE:

The State Personnel Article Review Committee notes, for consideration by the
General Assembly, that former Art. 64A, § 37A(a) and § 37(c) refer expressly to both
employees and "appointed officials". These express references to "appointed officials"
have been retained in § 7-101(a) (rulemaking), § 7-301(a) (annual leave), and § 7-801(a)
(compensatory leave). No similar references, however, appear elsewhere in the source
law for this title. See, e.g., former Art. 64A, § 37(a)(5), revised in § 7-401(a) (personal
leave). The State Personnel Article Review Committee is uncertain as to whether and to
what extent the other provisions of this title that refer only to "employees" are intended
to apply to appointed officials as well.

TITLE 8. BENEFITS.

SUBTITLE 1. HEALTH AND WELFARE BENEFITS PROGRAM.

8-101. "PROGRAM" DEFINED.

IN THIS SUBTITLE, "PROGRAM" MEANS THE STATE EMPLOYEE AND RETIREE
HEALTH AND WELFARE BENEFITS PROGRAM.

REVISOR'S NOTE: This section is new language added to conform the
inconsistent references in former Art. 64A, §§ 48 through 48E to the
"employee and retiree benefits programs", "benefits plan", "State
Employees' Health Insurance Program", and State "program of hospital,
medical, and surgical insurance".

8-102. ESTABLISHMENT AND SCOPE OF PROGRAM.

(A)     PROGRAM ESTABLISHED.

THERE IS A STATE EMPLOYEE AND RETIREE HEALTH AND WELFARE BENEFITS
PROGRAM, TO BE DEVELOPED AND ADMINISTERED BY THE SECRETARY.
