SUBTITLE 9. FAMILY AND SEASONAL LEAVE.

7-901. SCOPE OF SUBTITLE.

THIS SUBTITLE APPLIES TO ALL CLASSIFIED SERVICE AND UNCLASSIFIED
SERVICE EMPLOYEES OF ANY UNIT IN THE EXECUTIVE BRANCH OF STATE
GOVERNMENT.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 64A, § 37C(a)(1), (2), and (3). Although former Art.
64A, § 37C(a)(1), (2), and (3) were definitions, they are revised as a scope
section for clarity, reflecting long-standing Departmental understanding and
administrative practice.

The former reference to "all offices... directly responsible to the Governor" is
deleted as unnecessary in light of the broad reference to "any unit in the
executive branch of State government".

"Unclassified service" § 1-101

7-902. FAMILY AND SEASONAL LEAVE AUTHORIZED.

(A)     IN GENERAL.

ON REQUEST, AN EMPLOYEE SUBJECT TO THIS SUBTITLE WHO IS NOT ON
PROBATION MAY BE GRANTED FAMILY LEAVE OR SEASONAL LEAVE, SUBJECT TO
THE REQUIREMENTS OF THIS SUBTITLE.

(B)      LEAVE TO BE UNPAID.

FAMILY AND SEASONAL LEAVE SHALL BE WITHOUT PAY.

(C)      LEAVE MAY NOT BE REQUIRED.

AN EMPLOYEE MAY NOT BE REQUIRED TO TAKE FAMILY OR SEASONAL
LEAVE.

(D)     USES OF FAMILY LEAVE.

FAMILY LEAVE MAY BE USED ONLY AS NEEDED TO CARE FOR:

(1)      A NEWLY-BORN OR NEWLY-ADOPTED CHILD OF THE EMPLOYEE;

(2)      A FOSTER CHILD PLACED WITH THE EMPLOYEE;

(3)      A SERIOUSLY ILL OR DISABLED CHILD, SPOUSE, PARENT, OR LEGAL
DEPENDENT OF THE EMPLOYEE; OR

(4)      A SCHOOL-AGE CHILD OF THE EMPLOYEE UNDER AGE 14 DURING
SCHOOL VACATION.

change from former Art. 64A, § 37C(a)(4), the second clause of § 37C(c), §
37C(d)(5), and § 37C(e).
