WILLIAM DONALD SCHAEFER, Governor

Ch. 10

As to the uniform use in this section and throughout this subtitle of the phrase
"illness or disability", see General Revisor's Note to this subtitle.

7-505. CERTIFICATE OF ILLNESS.

FOR EACH 30-DAY PERIOD IN WHICH AN EMPLOYEE USES SICK LEAVE FOR 3
OR MORE CONSECUTIVE WORKDAYS FOR PERSONAL ILLNESS OR DISABILITY, THE
EMPLOYEE MAY NOT RECEIVE PAYMENT UNDER THIS SUBTITLE UNLESS THE
EMPLOYEE GIVES THE EMPLOYEE'S IMMEDIATE SUPERVISOR AN ORIGINAL
CERTIFICATE OF ILLNESS OR DISABILITY SIGNED BY ONE OF THE FOLLOWING:

(1)      AN ACCREDITED CHRISTIAN SCIENCE PRACTITIONER; OR

(2)      A PERSON WHO IS LICENSED OR CERTIFIED AS A:

(I)       CHIROPRACTOR;

(II)     CLINICAL PSYCHOLOGIST;

(III)    DENTIST;

(IV)    LICENSED CERTIFIED SOCIAL WORKER - CLINICAL;

(V)     NURSE MIDWIFE;

(VI)    NURSE PRACTITIONER;

(VII)     ORAL SURGEON;

(VIII)    PHYSICAL THERAPIST;

(IX)        PHYSICIAN; OR

(X)     PODIATRIST.

REVISOR'S NOTE: This section is new language derived from the third sentence
of former Art. 64A, § 37(a)(3)(ii).

In the introductory clause of this section, the phrase "for personal illness or
disability" is added for clarity. The State Personnel Article Review Committee
notes, however, for consideration by the General Assembly, that the
Committee is uncertain whether the certification requirement was also
intended to apply to leave for family illness or disability.

As to the uniform use in this section and throughout this subtitle of the phrase
"illness or disability", see General Revisor's Note to this subtitle.

7-506. UNUSED SICK LEAVE.

(A)     ACCUMULATION AUTHORIZED.

AN EMPLOYEE MAY ACCUMULATE UNUSED SICK LEAVE AND USE IT AT ANY
TIME.

(B)      FORFEITURE ON TERMINATION OF EMPLOYMENT.
