7-404. UNUSED PERSONAL LEAVE.

(A)     ACCUMULATION NOT AUTHORIZED.

AN EMPLOYEE MAY NOT ACCUMULATE UNUSED PERSONAL LEAVE.

(B)     CONTRIBUTIONS TO LEAVE RESERVE FUND.

AT THE END OF EACH CALENDAR YEAR, THE UNUSED PERSONAL LEAVE OF
ALL EMPLOYEES BECOMES PART OF THE STATE EMPLOYEES' LEAVE RESERVE FUND
ESTABLISHED BY § 7-510 OF THIS TITLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from the second clause of the first sentence of former Art. 64A, §
37(a)(5)(i).

SUBTITLE 5. SICK LEAVE.

7-501. SCOPE OF SUBTITLE.

THIS SUBTITLE APPLIES TO ALL CLASSIFIED SERVICE AND UNCLASSIFIED
SERVICE EMPLOYEES IN THE STATE PERSONNEL MANAGEMENT SYSTEM.

REVISOR'S NOTE: This section is new language added to clarify the scope of this
subtitle in accordance with long-standing Departmental understanding and

administrative practice. See 77 Op. Att'y Gen. ____ (1992) [Opinion No.

92-016 (May 20, 1992)].

Defined terms: "Classified service" § 1-101

"State Personnel Management System" § 1-101
"Unclassified service" § 1-101

7-502. SICK LEAVE AUTHORIZED.

(A)     IN GENERAL.

EACH EMPLOYEE SUBJECT TO THIS SUBTITLE IS ENTITLED TO SICK LEAVE
WITH PAY AS PROVIDED IN THIS SUBTITLE.

(B)     USES FOR LEAVE.
SICK LEAVE MAY BE USED:

(1)      FOR ILLNESS OR DISABILITY OF THE EMPLOYEE;

(2)      FOR DEATH, ILLNESS, OR DISABILITY IN THE EMPLOYEE'S
IMMEDIATE FAMILY; OR

(3)      FOLLOWING THE EMPLOYEE'S ADOPTION OF A CHILD.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first sentence of former Art. 64A, § 37(a)(3)(ii), the first
clause of the first sentence of § 37(a)(3)(i), as it authorized sick leave, the
second and third clauses of the second sentence of § 37(a)(4), and, as it
allowed sick leave to be used following an adoption, § 37(i)(2).
