REVISOR'S NOTE: This section is new language derived without substantive
change from the third sentence of former Art. 64A, § 37(c), except as it
related to compensatory leave.

7-308. FORFEITURE AND DISQUALIFICATION.

(A)     TERMINATION FOR MORAL TURPITUDE.

AN EMPLOYEE WHOSE STATE EMPLOYMENT IS TERMINATED FOR A CAUSE
INVOLVING MORAL TURPITUDE FORFEITS ALL UNUSED ANNUAL LEAVE AND ALL
COMPENSATION FOR UNUSED ANNUAL LEAVE.

(B)     TERMINATION WITHIN 6 MONTHS OF APPOINTMENT.

AN EMPLOYEE WHOSE STATE EMPLOYMENT TERMINATES WITHIN 6 MONTHS
AFTER THE EMPLOYEE'S ORIGINAL APPOINTMENT IS NOT ELIGIBLE FOR ANNUAL
LEAVE OR COMPENSATION FOR ANNUAL LEAVE.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first and second sentences of former Art. 64A, § 37(c).

As to the deletion of the former limited reference to a "classified employee",
see Revisor's Note to § 7-301 of this subtitle.

The State Personnel Article Review Committee notes, for consideration by
the General Assembly, that the meaning of the phrase "original appointment"
in subsection (b) of this section is unclear. Does it mean the appointment to
the current period of employment or the date of some previous employment,
regardless of the length of time between the periods of State employment? Cf.
Title 11, Subtitle 1 of this article.

SUBTITLE 4. PERSONAL LEAVE.

7-401. SCOPE OF SUBTITLE.

THIS SUBTITLE APPLIES TO ALL CLASSIFIED SERVICE AND UNCLASSIFIED
SERVICE EMPLOYEES IN THE STATE PERSONNEL MANAGEMENT SYSTEM.

REVISOR'S NOTE: This section is new language added to clarify the scope of this
subtitle in accordance with long-standing Departmental understanding and
administrative practice. See 77 Op. Att'y Gen. _____ (1992) [Opinion No.
92-016 (May 20, 1992)].

Defined terms: "Classified service" § 1-101

"State Personnel Management System" § 1-101
"Unclassified service" § 1-101

7-402. PERSONAL LEAVE AUTHORIZED.

(A) IN GENERAL.

EACH EMPLOYEE SUBJECT TO THIS SUBTITLE IS ENTITLED TO 3 DAYS OF
PERSONAL LEAVE WITH PAY IN A CALENDAR YEAR.
