Ch. 10

Subsection (b)(2) of this section is new language added to reflect Art. 1, § 27,
which provides for the observance of holidays that occur on a Sunday.

In this section, the phrase "[e]xcept as otherwise provided in this subtitle" is
added to reflect the exception contained in § 7-204 of this subtitle.

7-204. FLOATING HOLIDAYS.

(A)     DAILY STATE OPERATIONS.

THE STATE GOVERNMENT MAINTAINS OPERATIONS ON THE DAYS WHEN THE
FOLLOWING HOLIDAYS ARE OBSERVED:

(1)      DEFENDER'S DAY;

(2)      GOOD FRIDAY;

(3)      LINCOLN'S BIRTHDAY; AND

(4)      MARYLAND DAY.

(B)      LEAVE ON ALTERNATIVE WORKDAY.

AN EMPLOYEE WHO WORKS ON ANY OF THE HOLIDAYS LISTED IN SUBSECTION
(A) OF THIS SECTION MAY REQUEST LEAVE WITH PAY ON AN ALTERNATIVE
WORKDAY.

(C)      APPROVAL REQUIRED.

THE APPOINTING AUTHORITY SHALL APPROVE A REQUEST MADE UNDER
SUBSECTION (B) OF THIS SECTION UNLESS THE APPOINTING AUTHORITY
DETERMINES THAT THE EMPLOYEE'S ABSENCE ON THE REQUESTED ALTERNATIVE
WORKDAY WILL INTERFERE UNDULY WITH THE CONDUCT OF PUBLIC BUSINESS.

(D)     LIMITATION ON USE.
LEAVE UNDER THIS SECTION:

(1)       MAY NOT BE USED BEFORE THE HOLIDAY IS OBSERVED; AND

(2)       IS FORFEITED IF IT IS NOT USED BEFORE THAT HOLIDAY IS NEXT
OBSERVED.

REVISOR'S NOTE: This section is new language derived without substantive
change from the second sentence of former Art. 89, § 28(a) and § 28(b).

7-205. COMPENSATORY TIME FOR HOLIDAY WORK — GENERALLY.

EXCEPT FOR A HOLIDAY LISTED IN § 7-204 OF THIS SUBTITLE AND EXCEPT AS
OTHERWISE PROVIDED IN § 7-206 OF THIS SUBTITLE OR IN ANY OTHER LAW, AN
EMPLOYEE WHO BECAUSE OF THE NATURE OF THE EMPLOYEE'S DUTIES IS
REQUIRED TO WORK ON ANY PART OF A HOLIDAY LISTED IN ARTICLE 1, § 27 OF THE
CODE SHALL RECEIVE COMPENSATORY TIME FOR THAT WORK.
