shift" that starts between 2 p.m. and 1 a.m. is inconsistent with COMAR
06.01.01.14B(2), which states that employees who work on a "permanent
part-time shift which starts between 2 p.m. and 1 a.m." are also eligible for
shift differential pay. Finally, the reference in subsection (a)(2) to "qualifying
hours" for fire fighters is uncertain given the law's silence as to how or which
hours qualify.

6-202. HAZARDOUS DUTY PAY.

(A)     IN GENERAL.

AN EMPLOYEE OF THE STATE FIRE MARSHALS OFFICE IS ENTITLED TO EXTRA
PAY, KNOWN AS HAZARDOUS DUTY PAY, IF THE EMPLOYEE WORKS AS A MEMBER
OF A BOMB SQUAD OR AS AN EXPLOSIVES TECHNICIAN.

(B)      MONTHLY PAY LIMIT.

HAZARDOUS DUTY PAY UNDER THIS SECTION SHALL BE SET BY THE
SECRETARY IN AN AMOUNT NOT TO EXCEED $50 A MONTH.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 64A, § 27(e).

In subsection (a) of this section, the reference to "hazardous duty pay" is
added to conform to current terminology. Similarly, the term "explosives
technician" is substituted for "[b]omb technician" and "[f]ire investigators
(explosives)".

In subsection (b) of this section, the former reference to a maximum of "$600
per year" is deleted as equivalent to "$50 a month".

SUBTITLE 3. OVERTIME COMPENSATION.

6-301. SCOPE OF SUBTITLE.

(A)     IN GENERAL.

EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, IN § 6-309 OF THIS
SUBTITLE, OR OTHERWISE BY LAW, THIS SUBTITLE APPLIES TO ALL EMPLOYEES,
INCLUDING CLASSIFIED, UNCLASSIFIED, FULL-TIME, PART-TIME, PERMANENT,
TEMPORARY, AND CONTRACTUAL EMPLOYEES, OF ALL UNITS IN THE EXECUTIVE,
JUDICIAL, AND LEGISLATIVE BRANCHES OF STATE GOVERNMENT, INCLUDING ANY
UNIT WITH AN INDEPENDENT PERSONNEL SYSTEM.

(B)      EXCEPTION.
