SUBTITLE 6. TRANSFERS.

4-601. IN GENERAL.

(A)     REGULATIONS.

THE SECRETARY SHALL ADOPT REGULATIONS TO PROVIDE FOR THE
TRANSFERS OF CLASSIFIED SERVICE EMPLOYEES TO:

(1)      DIFFERENT POSITIONS;

(2)      POSITIONS IN A DIFFERENT CLASS; AND

(3)      POSITIONS IN DIFFERENT UNITS.

(B)     COMPLIANCE.

A TRANSFER SHALL COMPLY WITH THIS SUBTITLE AND THE REGULATIONS
ADOPTED UNDER IT.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first and third clauses of the second sentence of former Art.
64A, § 31.

In this section and throughout this subtitle, references to "classified service
employees" are added to conform to the interpretation of the Department of
Personnel and the apparent legislative intent.

In subsection (a)(3) of this section, the reference to "units" is substituted for
the former reference to a "department" to reflect the interpretation of the
Department of Personnel and the apparent legislative intent.

4-602. TRANSFERS BETWEEN UNITS.

A CLASSIFIED SERVICE EMPLOYEE MAY NOT BE TRANSFERRED FROM ONE
PRINCIPAL DEPARTMENT OR OTHER INDEPENDENT UNIT TO A DIFFERENT
PRINCIPAL DEPARTMENT OR OTHER INDEPENDENT UNIT WITHOUT THE CONSENT
OF THE RESPECTIVE APPOINTING AUTHORITIES.
