3-102. NOTICE REQUIRED.

ALL EMPLOYEES SUBJECT TO THIS SUBTITLE SHALL BE NOTIFIED OF THE
LOCATION, AT THE WORK SITE, OF A COPY OF:

(1)      THIS DIVISION I OF THIS ARTICLE; AND

(2)      ALL APPLICABLE PERSONNEL POLICIES AND REGULATIONS.

change from former Art. 64A, § 55(c).

SUBTITLE 2. POLITICAL ACTIVITIES.

3-201. SCOPE OF SUBTITLE; SECRETARY'S AUTHORITY.

(A)     SCOPE OF SUBTITLE.

THIS SUBTITLE APPLIES TO ALL EMPLOYEES, INCLUDING CLASSIFIED,
UNCLASSIFIED, FULL-TIME, PART-TIME, PERMANENT, TEMPORARY, AND
CONTRACTUAL EMPLOYEES, OF ALL UNITS IN THE EXECUTIVE, JUDICIAL, AND
LEGISLATIVE BRANCHES OF STATE GOVERNMENT, INCLUDING ANY UNIT WITH AN
INDEPENDENT PERSONNEL SYSTEM.

(B)      SECRETARY'S AUTHORITY.

THE RULEMAKING AND OTHER AUTHORITY OF THE SECRETARY WITH
RESPECT TO THIS SUBTITLE EXTENDS ONLY TO THOSE EMPLOYEES WHO ARE IN THE
STATE PERSONNEL MANAGEMENT SYSTEM.

REVISOR'S NOTE: Subsection (a) of this section is new language added for
clarity, reflecting the broad scope of former Art. 33, §§ 28-1 and 28-2 and Art.
41, § 1-302, from which this subtitle is revised. It is patterned after the
similarly broad provisions of former Art. 64A, § 37B(a), revised as § 7-701 of
this article.

Subsection (b) of this section is new language added to reflect that, as a
general matter, the Secretary's authority extends only to provisions that are
derived from former Art. 64A and not to provisions, such as those revised in
this subtitle, that are derived from other parts of the Code.

"State Personnel Management System" § 1-101

3-202. PUBLIC POLICY.

EMPLOYMENT BY THIS STATE DOES NOT AFFECT ANY RIGHT OR OBLIGATION
OF A CITIZEN UNDER THE CONSTITUTION AND LAWS OF THE UNITED STATES OR
UNDER THE CONSTITUTION AND LAWS OF THIS STATE.

REVISOR'S NOTE: This section is new language derived without substantive
change from the second clause of former Art. 33, § 28-1, as it related to State
employees.
