2-303. APPROVAL OF PROPOSED DECISIONS.

THE SECRETARY MAY DELEGATE TO THE DEPUTY SECRETARY, AN ASSISTANT
SECRETARY, OR ANOTHER OFFICIAL IN THE DEPARTMENT WHOSE DUTIES ARE
UNRELATED TO THE HEARING PROCESS, THE AUTHORITY TO APPROVE A
PROPOSED DECISION ISSUED:

(1)      UNDER § 2-302 OF THIS SUBTITLE; OR

(2)      IN A GRIEVANCE ARBITRATION UNDER § 10-209(C) OF THIS ARTICLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 64A, § 36A(c)(l) and § 36A(c)(3) through (7).

In item (1) of this section, the former detailed description of the various
proceedings that were also listed in former § 36A(b) is deleted and a
cross-reference is substituted for brevity.

The State Personnel Article Review Committee notes, for consideration by
the General Assembly, that the requirement that a designee must have "duties
... unrelated to the hearing process" may be obsolete. As originally enacted,
this provision referred to the "Employer-Employee Relations Division" of the
Department of Personnel, which then conducted hearings. Those "hearing
process" duties are now performed by the Office of Administrative Hearings.

2-304. APPEALS CONNECTED WITH UNIVERSITY OF MARYLAND SYSTEM.

IN AN APPEAL SUBMITTED TO THE SECRETARY UNDER TITLE 13, SUBTITLE 1A
OF THE EDUCATION ARTICLE, THE SECRETARY MAY DELEGATE AUTHORITY IN A
WAY THAT IS CONSISTENT WITH THE OTHER DELEGATIONS ALLOWED UNDER THIS
SUBTITLE.

change from former Art. 64A, § 36A(d).

2-305. NOTICE REQUIREMENT.

WITHIN 30 DAYS AFTER A DELEGATION OF AUTHORITY IS MADE UNDER THIS
SUBTITLE, THE SECRETARY SHALL PUBLISH NOTICE OF THE DELEGATION IN THE
MARYLAND REGISTER.
