previously held ... or ... to a position of equal responsibilities, qualifications,
and rate of pay"; and § 11-205(b), referring to the "reinstate[ment]" of
disabled veterans "to a position that ... provides the ... pay, seniority, and
status that are the same as or as similar as ... circumstances ... allow to ... the
position previously held".

In this regard, the State Personnel Article Review Committee notes, for
consideration by the General Assembly, that the Committee is uncertain
whether and to what extent this definition was intended to apply to all other
uses in this Division I of "reinstate" or only to one or another specific use of
the term. See, e.g., § 3-307(c) ("reinstate[ment]" under the Whistleblower
Law); § 4-205(b)(4) (preference for veterans upon "reemployment ... or
reinstatement"); § 4-402(a) (probation when employee is "reinstated"); §
9-405(c) ("reinstate[ment]" of suspended employee after management delay);
§ 11-101 (period for "reinstatement"); and § 11-102 (benefits for employee
with an "authorized status of reinstatement").

Defined term: "Class" § 1-101

(L) SECRETARY.

"SECRETARY" MEANS THE SECRETARY OF PERSONNEL.

REVISOR'S NOTE: This section formerly was Art. 64A, § 1(18).

There are no changes.

(M) STATE.

"STATE" MEANS:

(1)      A STATE, POSSESSION, TERRITORY, OR COMMONWEALTH OF THE
UNITED STATES; OR

(2)      THE DISTRICT OF COLUMBIA.

REVISOR'S NOTE: This subsection is standard language added to avoid
repetition of phrases such as "state, possession, territory, the District of
Columbia, or the Commonwealth of Puerto Rico or the Northern Mariana
Islands".

(N) STATE PERSONNEL MANAGEMENT SYSTEM.

"STATE PERSONNEL MANAGEMENT SYSTEM" MEANS THE PERSONNEL SYSTEM
ESTABLISHED UNDER § 1-201 OF THIS TITLE.

REVISOR'S NOTE: This subsection is new language added for clarity. See
Revisor's Note to § 1-201 of this title.

(O) UNCLASSIFIED SERVICE.

(1) "UNCLASSIFIED SERVICE" MEANS ALL OF THOSE POSITIONS IN THE
STATE PERSONNEL MANAGEMENT SYSTEM THAT ARE EXCLUDED FROM THE
CLASSIFIED SERVICE BY LAW.
