(b) A claim filed under this subtitle and an initial pleading filed in any subsequent
action may not contain a statement of the amount of damages sought other than that they are
more than a required jurisdictional amount.
(C) IN ANY ACTION FOR DAMAGES FILED UNDER THIS SUBTITLE, THE HEALTH
CARE PROVIDER IS NOT LIABLE FOR THE PAYMENT OF DAMAGES UNLESS IT IS
ESTABLISHED THAT THE CARE GIVEN BY THE HEALTH CARE PROVIDER IS NOT IN
ACCORDANCE WITH THE STANDARDS OF PRACTICE AMONG MEMBERS OF THE SAME
HEALTH CARE PROFESSION WITH SIMILAR TRAINING AND EXPERIENCE SITUATED IN
THE SAME OR SIMILAR COMMUNITIES AT THE TIME OF THE ALLEGED ACT GIVING RISE
TO THE CAUSE OF ACTION.
[(c)](D) Except as otherwise provided, the Maryland Rules of Procedure shall apply
to all practice and procedure issues arising under this subtitle.
Article - Health - General
SUBTITLE 15. MEDICAL CARE DATA REVIEW MARYLAND HEALTH CARE ACCESS AND
COST COMMISSION
19-1501.
(A) IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.
(B) "COMMISSION" MEANS THE MEDICAL CARE DATA REVIEW MARYLAND
HEALTH CARE ACCESS AND COST COMMISSION.
(C) "COMPREHENSIVE STANDARD HEALTH BENEFIT PLAN" MEANS THE
COMPREHENSIVE STANDARD HEALTH BENEFIT PLAN ADOPTED IN ACCORDANCE
WITH ARTICLE 48A, § 700 OF THE CODE.
(D) "HEALTH CARE PRACTITIONER" MEANS ANY PERSON THAT PROVIDES
HEALTH CARE SERVICES AND IS LICENSED UNDER THE HEALTH OCCUPATIONS
ARTICLE.
(C) (D) (1) (E) "HEALTH CARE SERVICE" MEANS ANY HEALTH OR
MEDICAL CARE PROCEDURE OR SERVICE RENDERED BY A PHYSICIAN,
PHARMACIST, OR OFFICE FACILITY- HEALTH CARE PRACTITIONER THAT:
(I) (1) PROVIDES TESTING, DIAGNOSIS, OR TREATMENT OF
HUMAN DISEASE OR DYSFUNCTION; OR
(II) (2) DISPENSES DRUGS, MEDICAL DEVICES, MEDICAL
APPLIANCES, OR MEDICAL GOODS FOR THE TREATMENT OF HUMAN DISEASE OR
DYSFUNCTION.
(2) "HEALTH CARE SERVICE" DOES NOT INCLUDE HOSPITAL SERVICES
AS DEFINED IN § 19-201 OF THIS TITLE.
(D) (E) (F) (1) "OFFICE FACILITY" MEANS THE OFFICE OF ONE OR MORE
PHYSICIANS IN WHICH HEALTH CARE SERVICES ARE PROVIDED TO INDIVIDUALS.
