conduct certain examinations; requiring the Commission to assess certain fees on
payors for health care; requiring the Insurance Commissioner to transfer certain
fees to the Commission; and generally relating to the Medical Care Data Review
Commission and the financing and duties of the Commission; adopting a certain
standard for use in medical malpractice cases in the State; creating the Maryland Health
Care Access and Cost Commission (Access and Cost Commission) and the Advisory
Committee on Practice Parameters (Advisory Committee) in the Department of Health
and Mental Hygiene for certain purposes; providing for the membership, terms,
procedures, powers, and duties of the Commission and the Advisory Committee;
authorizing the Commission and the Advisory Committee to appoint executive directors
under certain circumstances; requiring certain reports; ensuring confidentiality for certain
information; limiting the power of the Secretary of Health and Mental Hygiene over the
Commission and the Advisory Committee; requiring insurers and health maintenance
organizations to submit certain information to the Insurance Commissioner and to the
Access and Cost Commission; requiring the Commissioner to examine certain
information; authorizing the Access and Cost Commission to license certain Medical
Care Electronic Claims Clearinghouses; requiring the Access and Cost Commission to
establish a statewide Medical Care Data Base; requiring the Access and Cost
Commission to adopt certain regulations specifying a comprehensive standard health
benefit plan; requiring the Access and Cost Commission to publish a certain report,
consult with certain representatives, and develop a certain system to provide certain
information to certain health care practitioners; authorizing the Commission to contract
with certain qualified independent third parties for any service necessary to carry out
certain powers and duties; authorizing the Commission to conduct certain examinations;
requiring the Insurance Commissioner and the Access and Cost Commission to assess
certain fees on certain persons; establishing the Health Care Access and Cost Fund to be
used for the purposes of the Access and Cost Commission; requiring the Insurance
Commissioner to transfer certain fees to the Fund; providing that the Advisory
Committee on Practice Parameters shall establish certain standards for medical practice
parameters; authorizing the Commission to appoint certain advisory committees;
providing for a Standard Benefit Plan Task Force; authorizing the Commission to
investigate certain issues; making the provisions of this Act severable; and generally
relating to health care and health insurance reform.
