Ch. 8                                        1993 LAWS OF MARYLAND

SECTION 25. AND BE IT FURTHER ENACTED, That:

(1) On or before June 1, 1993, the Secretary of Budget and Fiscal Planning shall
approve a schedule to abolish at least 308 positions in the executive branch. This schedule
shall result in savings in general or sp
ecial funds of at least $6.8 million for Fiscal Year

1994.

(2) On or before June 30, 1993, the Governor shall present this schedule to the
Board of Public Works in order that these positions and associated funds may be reduced
from the budget under provisions in Section 7-213 of the State Finance and Procurement
Article.

(3) For Fiscal Year 1994 only, special funds associated with positions abolished
under this section shall be transferred to the General Fund as provided by legislation.

(4) It is the intent of the General Assembly that in identifying positions to be
abolished under this section, the Secretary shall, to the extent consistent with maintaining
public safety and preserving essential services, emphasize selection of vacant positions.

SECTION 25. AND BE IT FURTHER ENACTED, That:

(1)     If S.B. 93, establishing an early retirement program, is enacted, at least $8.2
million in general and special funds associated with positions abolished under that legislation
shall be credited to the general fund for fiscal year 1994 as provided in the legislation.

(2)     If S.B. 93 is not enacted:

(A)     On or before June 1, 1993, the Secretary of Budget and Fiscal Planning shall
approve a schedule to abolish at least 300 positions in the executive branch. This schedule
shall result in savings in general or special funds of at least $8.2 million for Fiscal Year 1994.

(B)     On or before June 30, 1993, the Governor shall present this schedule to the Board
of Public Works in order that these positions and associated funds may be reduced from the
budget under provisions of Section 7-213 of the State Finance and Procurement Article.

(C)    For Fiscal Year 1994 only, special funds associated with positions abolished under
this section shall be transferred to the General Fund as provided by legislation.

(D)    It is the intent of the General Assembly that in identifying positions to be abolished
under this section, the Secretary shall, to the extent consistent with maintaining public safety
and preserving essential services, emphasize selection of vacant positions.

SECTION 26. AND BE IT FURTHER ENACTED, That funds may not be
expended by State agencies from appropriations in this Act for the purpose of
encouraging individuals or private entities to become advocates in favor of or again
st
legislation being considered by the General Assembly. This limitation does not apply to a
State agency responding to inquiries with respect to pending legislation or to a State
agency communicating directly with the General Assembly with respect to pondin
g
legislation.

SECTION 26. AND BE IT FURTHER ENACTED, That the fiscal year 1994
appropriations made in Section 1 to the programs listed below shall be reduced by the amounts
indicated for the purpose of reducing workers' compensation unfunded liability payments:
