FOR the purpose of authorizing certain persons to consent to the immunization of a
minor if a parent or certain other responsible individuals are unavailable under
certain circumstances; prohibiting consent by another person if the parent or other
responsible individuals expressly refuses to give consent to an immunization under
certain circumstances; authorizing the delegation of consent by a parent or certain
other responsible individuals; authorizing the Department of Health and Mental
Hygiene to adopt regulations; authorizing the Juvenile Services Administration to
consent to immunization in certain circumstances; providing limited liability from
immunity for certain persons; making this Act an emergency measure; and generally
relating to the consent to immunization of a minor.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Health - General
SUBTITLE 4A. CONSENT TO IMMUNIZATION OF MINORS
18-4A-01.
(A) THE FOLLOWING INDIVIDUALS MAY CONSENT TO THE IMMUNIZATION OF
A MINOR IF A PARENT, GUARDIAN OF THE MINOR, OR OTHER PERSON WHO, UNDER
A COURT ORDER, MAY CONSENT FOR THE MINOR CANNOT BE CONTACTED AND THE
AUTHORITY TO CONSENT IS NOT DENIED UNDER SUBSECTION (D) OF THIS SECTION:
(1) A GRANDPARENT;
(2) AN ADULT BROTHER OR SISTER;
(3) AN ADULT AUNT OR UNCLE;
(4) A STEPPARENT;
(5) AN EDUCATIONAL INSTITUTION IN WHICH THE MINOR IS ENROLLED
AND THAT HAS WRITTEN AUTHORIZATION TO CONSENT FOR THE MINOR FROM A
PARENT, GUARDIAN OF THE MINOR, OR OTHER PERSON WHO, UNDER A COURT
ORDER, MAY CONSENT FOR THE MINOR;
(6) ANOTHER ADULT WHO HAS CARE AND CONTROL OF THE MINOR
AND HAS WRITTEN AUTHORIZATION TO CONSENT FOR THE MINOR FROM A
PARENT, GUARDIAN OF THE MINOR, OR OTHER PERSON WHO, UNDER A COURT
ORDER, MAY CONSENT FOR THE MINOR;
(7) A COURT THAT HAS JURISDICTION OF A SUIT AFFECTING THE
PARENT CHILD RELATIONSHIP OF WHICH THE MINOR IS THE SUBJECT;
