FOR the purpose of limiting the participation by the Metropolitan Baltimore Council
Baltimore Metropolitan Council, as a municipal corporation, in the Employees'
Retirement System and the Pension System for Employees to certain employees
who were employed on a certain date by the Baltimore Regional Council of
Governments; and requiring certain contributions to be made before credit is
granted for a certain period of service with the Metropolitan Baltimore Council
Baltimore Metropolitan Council.
BY repealing and reenacting, with amendments,
Article 73B - Pensions
Section 10-101(e)(3)(xvi) and 10-103

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 73B - Pensions
10-101.
(e) (3) To participate in the Employees' Retirement System or the Pension
System for Employees of the State of Maryland, the following entities shall be considered
to be a municipal corporation:
(xvi) The Baltimore Metropolitan Council, BUT ONLY FOR
EMPLOYEES WHO WERE MEMBERS OF THE EMPLOYEES' RETIREMENT SYSTEM OR
THE PENSION SYSTEM FOR EMPLOYEES AS EMPLOYEES OF THE BALTIMORE
REGIONAL COUNCIL OF GOVERNMENTS ON JUNE 30, 1992; and
10-103.
(A) (1) Membership in the Employees' Retirement System or the Pension
System for Employees of the State of Maryland for the employees who are admitted
under § 10-102 of this subtitle shall be optional for the employees who are in the service
on the date the approval is given[, and any].
(2) EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, ANY
employee who elects to join this pension system within 1 calendar year, shall be entitled
to credit for service rendered before the date of approval.
(B) AN EMPLOYEE OF THE BALTIMORE METROPOLITAN COUNCIL WHO
ELECTS TO BECOME A MEMBER OF THE EMPLOYEES' RETIREMENT SYSTEM OR THE
PENSION SYSTEM FOR EMPLOYEES, MAY NOT RECEIVE CREDIT FOR SERVICE FROM
JULY 1, 1992 TO THE DATE OF APPROVAL UNLESS THE EMPLOYEE PAYS TO THE
BOARD OF TRUSTEES THE AMOUNT OF THE CONTRIBUTIONS THE EMPLOYEE
WOULD HAVE MADE DURING THAT PERIOD, PLUS REGULAR INTEREST.
