AN ACT concerning
Crimes of Violence - Pretrial Release Release of Defendant Pretrial
FOR the purpose of prohibiting the pretrial release of a person who, while on parole,
probation, or mandator)' release for a crime of violence, is charged with another
crime of violence; defining a certain term; and generally relating to pretrial release
prohibiting a District Court Commissioner from authorizing the release pretrial of
certain defendants charged with certain crimes of violence if the defendant is on
parole, probation, or mandatory supervision for another crime of violence; allowing
a judge to release pretrial certain defendants charged with certain crimes of
violence under certain circumstances; establishing a certain presumption applicable
to certain defendants charged with crimes of violence under certain circumstances;
and generally relating to releasing pretrial defendants charged with crimes of
violence.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

(K) (1) IN THIS SUBSECTION, "CRIME OF VIOLENCE" HAS THE MEANING
STATED IN § 643B(A) OF THIS ARTICLE.
(2) A PERSON WHO, WHILE ON PAROLE, PROBATION, OR MANDATORY
RELEASE FOR A CRIME OF VIOLENCE, IS CHARGED WITH ANOTHER CRIME OF
VIOLENCE MAY NOT BE RELEASED PRETRIAL.
