9-235.1.
(A) EACH COUNTY OR COUNTIES IN WHICH SEWAGE SLUDGE DISPOSAL SITES
ARE LOCATED MAY ESTABLISH A SEWAGE SLUDGE MANAGEMENT PROGRAM
COORDINATED WITH MARYLAND DEPARTMENT OF THE ENVIRONMENT AND SET
AND COLLECT A FEE, NOT TO EXCEED $2 PER TON OF SEWAGE SLUDGE DISPOSED
OF, TO BE PLACED IN A DEDICATED FUND TO ADMINISTER THE SEWAGE SLUDGE
MANAGEMENT PROGRAM IN THAT COUNTY OR COUNTIES.
(B) A COUNTY OR COUNTIES MAY USE THE FUNDS COLLECTED UNDER THIS
SECTION FOR THE ADMINISTRATION OF A SEWAGE SLUDGE MANAGEMENT
PROGRAM, INCLUDING:
(1) ANALYSIS OF SOILS TO DETERMINE THE AMOUNT OF SEWAGE
SLUDGE TO BE APPLIED IN ACCORDANCE WITH BEST NUTRIENT MANAGEMENT
PRACTICES;
(2) TESTING OF SEWAGE SLUDGE ON A TRUCK OR OTHER CONTAINER
BEFORE A LAND APPLICATION; AND
(3) MONITORING THE APPLICATION OF SEWAGE SLUDGE AT THE
DISPOSAL SITE.
(C) (1) A COUNTY OR COUNTIES MAY IMPOSE A PENALTY NOT TO EXCEED
$25 PER TON OF SEWAGE SLUDGE APPLIED, FOR AN APPLICATION OF SEWAGE
SLUDGE THAT IS NOT IN ACCORDANCE WITH RECOMMENDED AMOUNTS OR
METHODS ESTABLISHED BY THE COUNTY OR COUNTIES SEWAGE SLUDGE
MANAGEMENT PROGRAM.
(2) ANY MONEY COLLECTED FROM A PENALTY IMPOSED UNDER THIS
SECTION SHALL BE DEPOSITED IN THE GENERAL FUND OF THE STATE.
9-243.
(a) To enforce this Part III of this subtitle and to insure compliance with each
sewage sludge utilization permit, a representative of the Department [or] the local
health official, OR THE LOCAL HEALTH OFFICIAL'S DESIGNEE may enter and inspect, at
any reasonable time, any site where sewage sludge is utilized.
(b) A sewage sludge utilizer may not:
(1) Refuse access to a sewage sludge utilization site to any representative of
the Department, [or] to a local health official, OR TO THE LOCAL HEALTH OFFICIAL'S
DESIGNEE, who requests access under this section; or
(2) Interfere with any inspection under this subtitle.
(c) A local health official OR THE LOCAL HEALTH OFFICIAL'S DESIGNEE may
inspect, monitor, and investigate any sewage sludge utilization site in the county where
the official is employed.
