AN ACT concerning

Vehicle Laws - Refusal to Take Test - Withdrawal

FOR the purpose of providing that a person who initially refuses to take a certain test for
to determine the alcohol concentration or drug or controlled dangerous substance
content of the person's blood for the purposes of certain driving offenses and
subsequently consents to take the test may cure withdraw the initial refusal under
certain circumstances; providing that an initial refusal that is withdrawn as provided
under this Act is not a refusal to take a test for certain purposes; requiring certain
factors to be considered in determining whether the requirements for curing
withdrawing an initial refusal are met; providing for a certain burden of proof;
providing for the application of this Act; and generally relating to curing the
withdrawal of an initial refusal to take a certain test under certain circumstances.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 16-205.1(g) through (m), respectively, of
Article - Transportation of the Annotated Code of Maryland be renumbered to be
Section(s) 16-205.1(h) through (n), respectively.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

(G) (1) AN INITIAL REFUSAL TO TAKE A TEST THAT IS WITHDRAWN AS
PROVIDED IN THIS SUBSECTION IS NOT A REFUSAL TO TAKE A TEST FOR THE
PURPOSES OF THIS SECTION.
