(f) (1) Notwithstanding any other provision of law, any party of record to an
appeal of a decision of a local LICENSING board to the circuit court may appeal the
decision of the circuit court:
(i) To the Court of Special Appeals; or
(ii) By certiorari, to the Court of Appeals.
(2) The Court of Special Appeals or the Court of Appeals may not stay a
local LICENSING board's decision to impose sanctions on a licensee if:
(i) An appeal of a decision of a circuit court is made under this
section; and
(ii) The decision being appealed affirmed the decision of the local
[alcoholic beverages] licensing board.
SECTION 2. AND BE IT FURTHER ENACTED, That the Administrative
Office of the Courts shall develop procedures for the clerk of the circuit court for each
county affected by this Act to transfer to the board of license commissioners for the
county, or any other officer or agency designated by the county, blank forms and the
records that the clerk has maintained under Article 2B, § 147 of the Code or otherwise in
connection with the issuance of alcoholic beverages licenses or, in accordance with law,
otherwise to dispose of the forms and records that no longer are required in the office of
the clerk for budget, auditing, or other purposes.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act is not intended,
and may not be construed, to affect any license, permit, or other document issued under
Article 2B of the Code and those documents shall continue in effect in accordance with
the provisions of Article 2B of the Code.
SECTION 4. AND BE IT FURTHER ENACTED, That any provision of law that
requires the action of an official issuing a license or other document under Article 2B of
the Code shall be construed to refer to the official authorized under this Act to issue the
document, even if the document originally was issued by a clerk of court.
SECTION 5. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1993.
