[(b)](C) The information and records [that may be] disclosed under this section
shall be limited to:
(1) Demographic information to enable precise identification of the child;
(2) A listing of the types, dates, and duration of services provided by the
agency; [and]
(3) A listing of dates of any ASSESSMENTS OR evaluations performed by the
agency; AND
(4) INFORMATION AND RECORDS DETERMINED BY THE REQUESTING
AND SENDING AGENCIES TO BE NECESSARY FOR THE REQUESTING AGENCY TO
PROVIDE EFFECTIVE SERVICE PURSUANT TO ITS STATUTORY AUTHORITY.
[(c) (1)] (D) Information and records provided to another agency under this
section shall [be] REMAIN confidential AND MAY NOT BE DISCLOSED TO ANY PERSON
OR ENTITY EXCEPT AS PROVIDED FOR IN SUBSECTION (B) OF THIS SECTION.
[(2) Except where parental consent is exempted by law, information and
records under this section may be disclosed only after obtaining consent from the child's
parent or guardian.]
[(d)](E) Information and records provided to another agency under this section
shall be disposed of by the receiving agency 5 years after services to the child arc no
longer considered necessary.
(F) THE OFFICE FOR CHILDREN, YOUTH, AND FAMILIES SHALL DEVELOP
GUIDELINES FOR INFORMATION SHARING PURSUANT TO THIS SECTION.
12.
(a) The Office for Children, Youth, and Families shall be. the lead agency for
supervising and monitoring a statewide, community-based interagency system of
comprehensive early intervention services to eligible infants and toddlers, birth through
age 2, and their families.
(b) The interagency system shall include the early intervention services provided
or supervised by the State Departments of Education, Health and Mental Hygiene,
Human Resources, and Juvenile Services.
(c) The interagency system of early intervention services shall be administered in
accord with the applicable requirements of Federal Public Law 99-457 and other
applicable federal and State laws.
(d) An interagency coordinating council shall be appointed by the Governor, with
the advice and consent of the Senate, and shall:
(1) Advise and assist the Office for Children, Youth, and Families in the
supervision and monitoring of the interagency system of early intervention services; and
(2) Submit an annual report to the Governor and the federal government.
