Ch. 530                                     1993 LAWS OF MARYLAND

(ii) The designated areas under subparagraph (i) of this paragraph
shall be geographically located in order:

1.       To facilitate the commercial harvesting of finfish and
shellfish; and                               

2.       To assure reasonable access to the waterways of the State by
commercial watermen.

7-6A-03.1.                              

(A)     THE DEPARTMENT SHALL REVIEW MINERAL RESOURCES PLAN
ELEMENTS DEVELOPED BY LOCAL PLANNING COMMISSIONS UNDER ARTICLE 66B, §
3.05 OF THE CODE TO DETERMINE WHETHER THE PROPOSED PLAN IS CONSISTENT
WITH THE PROGRAMS AND GOALS OF THE DEPARTMENT.

(B)     THE DEPARTMENT SHALL MAKE ITS DETERMINATION WITHIN 60 DAYS

AFTER SUBMISSION BY A LOCAL PLANNING COMMISSION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1993.

(House Bill 508)

AN ACT concerning                   

Surface Mining - Legislative Intent - Balance of Effects and Land Uses

FOR the purpose of altering the legislative intent of the surface mining laws of the State
to provide that surface mining activities must be balanced against potential health,
safety, and environmental effects; requiring all reasonable steps to protect mineral
resources from certain encroachment by other land uses and to balance certain
mining activity against other possible, land uses, including consideration of uses for
surrounding properties; and generally relating to surface mining.'

BY repealing, and reenacting, with amendments,
