SUBTITLE 2. ADMINISTRATION
6-201.

(A)     (1) THERE IS A PUBLIC BODY POLITIC AND CORPORATE OF THE STATE
OF MARYLAND KNOWN AS THE WASHINGTON COUNTY SANITARY DISTRICT.

(2) THE DISTRICT MAY EXERCISE THE POWERS AND DUTIES
CONFERRED BY THIS TITLE IN ACCORDANCE WITH THE RESOLUTION PASSED BY
THE COUNTY ESTABLISHING THE DISTRICT.

(B)      BY EITHER ORDINANCE OR RESOLUTION, THE COUNTY MAY:

(1)       CHANGE THE NAME OF THE DISTRICT OR OF THE COMMISSION OR
BOTH;

(2)      AMEND THE BOUNDARIES OF THE DISTRICT; AND

(3)       CHANGE, ADD TO, OR DIMINISH THE POWERS AND PURPOSES OF
THE DISTRICT AND THE COMMISSION, PROVIDED THAT THE SAME ARE CONSISTENT
WITH OTHER PROVISIONS OF THIS TITLE AND THE CODE.

(C)      THE COUNTY SHALL ESTABLISH AND MAINTAIN A SUITABLE AND
PROPERLY INDEXED FILE FOR THE RECORDING OF DOCUMENTS UNDER THIS TITLE.

6-202.

(A) (1) THE COMMISSION SHALL EXERCISE THE POWERS OF THE DISTRICT
CONFERRED BY THIS TITLE.

(2)      THE COMMISSION SHALL CONSIST OF FIVE MEMBERS APPOINTED BY
THE COUNTY.

(3)      OF THE FIVE MEMBERS, THERE SHALL BE A RESIDENT OF EACH OF
THE FIVE REPRESENTATION AREAS OF THE DISTRICT.

(4)       (I) EACH MEMBER SERVES FOR A TERM OF FIVE YEARS
BEGINNING JANUARY 1 AFTER THE APPOINTMENT OF THE MEMBER AND UNTIL A
SUCCESSOR IS APPOINTED AND QUALIFIES.

(II)     THE TERMS OF MEMBERS SHALL BE STAGGERED AS REQUIRED
BY THE TERMS OF THE MEMBERS OF THE COMMISSION SERVING ON THE EFFECTIVE
DATE OF THIS ACT.

(III)    A MEMBER MAY SERVE FOR MORE THAN ONE TERM.

(5)      THE COUNTY MAY REMOVE A MEMBER FOR CONTINUED NEGLECT
OF DUTY, INCOMPETENCE, OR UNPROFESSIONAL OR UNETHICAL CONDUCT.

(6)       IF A VACANCY OCCURS BY DEATH, RESIGNATION, OR REMOVAL BY
THE COUNTY, THE COUNTY SHALL PROMPTLY APPOINT A SUCCESSOR TO FILL THE
UNEXPIRED TERM.
